U.S.T.R. Publishes Additional Exclusions to List 4A China 301 Tariffs; Some Exclusions Extended; Many Others Expire

Exclusions to List 4A

Section 301, List 4A, 9903.88.51

Retroactive to September 1, 2019, a new list of China 301 tariff exclusions has been announced by the U.S. Trade Representative to be claimed under subheading 9903.88.51. The list of exclusions are reflected in 61 specially prepared product descriptions responding to 86 exclusions requests and are to remain in place until September 1, 2020.

Exclusions Expiring July 9, 2020

Tariff exclusions that were granted July 2019 have expired today, July 9, 2020. That list of products will again be assessed the additional 25% China tariff.

Exclusions Extended through December 31, 2020

Sixth Round of Exclusions, Section 301, 9903.88.52

The U.S. Trade Representative has announced a further extension for items which were originally granted an extension on July 9, 2019. Effective July 9, 2020 and through December 31, 2020 these items originally classified in heading 9903.88.11 will be granted an extension of exclusion to China Section 301 Tariff.

Please review these lists to see if your products are affected. Importers are responsible for determining whether their product(s) meet the specific description next to the HTS – Harmonized Tariff Schedule. If your goods qualify for the exclusion, even if you did not request it, and wish to discuss a strategy for requesting retroactive refunds, please contact your local C J representative.
